1.About us and these terms
Tronix Malta (“Tronix”, “we”, “us”) sells products online to customers in Malta and Gozo through this website. These terms apply to every order you place with us. Please read them before ordering; by placing an order you agree to them.
Our business details:
- Legal name: [To be confirmed: registered business or company name]
- Registration number: [To be confirmed: company / business registration number]
- Registered address: [To be confirmed: geographic business address in Malta]
- VAT number: [To be confirmed: Maltese VAT number]
- Email: support@tronixmalta.com
These terms do not affect your statutory rights as a consumer under Maltese and EU law, including the Consumer Affairs Act (Chapter 378 of the Laws of Malta) and the regulations made under it. Where anything in these terms conflicts with those rights, your statutory rights prevail.
2.Products and product information
We take care to describe and photograph products accurately. Images are for illustration; colours and packaging can differ slightly, and supplier photos may show accessories or options that are not part of the item you order. The product title, selected options and description set out what you are buying.
Plugs and power. Malta uses Type G (three-pin, UK-style) sockets at 230V. Where a product page says an item is supplied with a different plug type (for example an EU plug), you may need a suitable adapter. Please check the plug type and specifications before ordering.
Products are intended for normal household, personal use. Please follow the instructions and safety information supplied with each product.
3.Placing an order and order acceptance
You place an order by adding items to your basket, continuing to our secure payment page and completing payment. Before you pay you can review your items, quantities and total and correct any mistakes. After payment you will see a confirmation page with your order number.
Your order is an offer to buy. A contract between you and us is formed when we accept your order, which happens when we confirm acceptance to you or dispatch the items, whichever is earlier. We may decline an order, for example if an item is no longer available, if there is an obvious pricing or description error, if we cannot deliver to the address given, or if we reasonably suspect fraud. If we decline or cannot fulfil an order (or part of it), we will tell you and refund the amount you paid for the affected items in full, using your original payment method, without undue delay.
We only accept orders for delivery to addresses in Malta and Gozo.
4.Prices, VAT and pricing errors
Prices are shown in euro and include Maltese VAT at the applicable rate (currently 18%). Delivery is free on all orders, so no delivery charge applies. The price you pay is the price shown at checkout when you place your order.
We check prices carefully, but errors can happen. If a product is listed at a price that is obviously and unmistakably incorrect, we are not obliged to supply it at that price. We will contact you before accepting the order and give you the option to continue at the correct price or cancel; if you have already paid, any amount for a cancelled item will be refunded in full.
All prices displayed include 18% Maltese VAT. Orders shipped to Malta and Gozo are dispatched with customs clearance handled; you will not be asked to pay any additional import VAT, customs duties or handling fees upon delivery.
5.Payment
Payments are processed by Stripe, our payment service provider. You enter your payment details on Stripe’s secure payment page; Tronix does not see or store your full card number. The payment methods available are those displayed on the payment page.
Payment is taken when you place your order. If a payment is declined or reversed, we will not dispatch the order.
6.Delivery
We deliver to Malta and Gozo. Please make sure your name, delivery address and phone number are complete and correct, as they are used by our delivery partners. If an order cannot be delivered because the details you gave were incorrect or incomplete, please contact us so we can help; we may need to agree any additional delivery costs with you.
Delivery times shown on the site and at checkout are estimates, not guaranteed dates. Unless we agree a different delivery period with you, we will deliver within 30 days after the contract is formed. If we do not deliver within the agreed period or within 30 days, you may give us an additional period appropriate to the circumstances; if we still do not deliver, you may end the contract and receive a full refund. You may end the contract immediately if delivery by a particular date was essential and you told us so before ordering.
Separate deliveries. Items in one order may be fulfilled by different suppliers and may arrive in separate parcels on different days. This does not affect your rights, including your right to withdraw, which for orders delivered in parts runs from when you receive the last item.
Risk in the products passes to you when you, or a person you nominate (other than the carrier), take physical possession of them.
7.Your right to cancel and returns
As a consumer buying at a distance you normally have the right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason, subject to legal exceptions. How this works, the exceptions and how refunds are made are explained in our Returns & Refunds Policy, which forms part of these terms.
8.Faulty and non-conforming goods
We are responsible for supplying goods that conform with the contract: as described, fit for purpose and of satisfactory quality. Under Maltese law you have a legal guarantee of conformity for at least two years from delivery. If goods are faulty, damaged, incorrect or otherwise not as described, you are entitled to have them brought into conformity (repair or replacement) free of charge, or in certain cases to a price reduction or a refund. See our Returns & Refunds Policy for how to tell us about a problem.
We do not offer any separate commercial warranty beyond your statutory rights unless one is expressly stated on a product page.
9.Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses (products are sold for domestic and private use).
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under product liability law, or for anything else that cannot be limited or excluded by law, and nothing in these terms affects your statutory rights as a consumer.
We are not responsible for delays or failures caused by events outside our reasonable control. If such an event affects your order, we will tell you, and you may cancel and receive a refund for items not yet delivered.
10.Your personal data
We use your personal data to process and deliver your order as described in our Privacy Policy.
11.Questions and complaints
If you have a question or a problem with an order, please contact us at support@tronixmalta.com with your order number. We aim to resolve complaints quickly and fairly.
If we cannot resolve a complaint, you may contact the Office for Consumer Affairs of the Malta Competition and Consumer Affairs Authority (MCCA), or bring a claim before the Consumer Claims Tribunal in Malta.
12.Governing law and jurisdiction
These terms and any contract between us are governed by the laws of Malta, and the courts and tribunals of Malta have jurisdiction. This does not deprive you of the protection of any mandatory consumer law that applies to you.
13.Changes to these terms
We may update these terms from time to time. The version in force when you place your order applies to that order.
